Terms of service
Effective October 16, 2026. Rasel Hakkani, trading as Swift Web Dev, Kodomtoli, New Bridge Rd, Gaibandha - 5700, Bangladesh.
These terms are an agreement between you (the customer, or the organisation you represent) and Rasel Hakkani, trading as Swift Web Dev ("we", "us") for the use of Swift Outbox (the "Service"). By creating an account or using the Service you accept them.
1. The Service
Swift Outbox helps you research leads, write personalised emails with AI, review them, send them from mailboxes you connect, and manage replies. We may improve or change features over time; we will not materially reduce the core Service during a paid period without notice.
2. Accounts
- You must be at least 18 and able to enter a contract. Accounts are for business use.
- You are responsible for your account credentials, for activity under your account, and for the people you invite to your workspaces.
- Tell us promptly at support@swiftoutbox.com if you suspect unauthorised access.
3. Your responsibilities when sending email
You are the sender of every email sent through the Service. You must follow the Acceptable use policy and all laws that apply to you and your recipients, including anti-spam and data protection laws (for example CAN-SPAM, GDPR, UK GDPR, PECR, CASL). You must have a lawful basis for contacting each lead and must honour opt-outs.
4. Mailboxes, AI providers and third-party services
When you connect your own mailboxes or AI keys, your use of those services is also governed by their terms. We are not responsible for their availability, limits or decisions (for example a provider suspending a mailbox).
5. Plans and payment
- Paid plans are billed in advance, monthly or yearly, through our payment processor. Prices are shown on the pricing page and exclude taxes unless stated.
- The Free plan costs nothing. We may change the Free plan and its limits. Paid plans are charged when you sign up.
- All purchases are final. A plan cannot be cancelled, refunded or downgraded after you buy it. You can upgrade to a higher plan at any time (or move the same plan from monthly to yearly billing). When you upgrade you pay the full price of the new plan, and a new billing period starts that day.
- Upgrade credit: if you upgrade within 7 days of buying your current plan, and you have not started any campaign, the amount you paid for the current plan (excluding tax) is taken off the price of the higher plan, once. In every other case the current plan is forfeited, is not refundable, and its remaining time is not carried over.
- Subscriptions renew automatically at the end of each billing period.
- If a payment fails we will retry and notify you. After a 7-day grace period, sending is paused and the account becomes read-only until payment succeeds.
- Payments are processed by Paddle, which acts as merchant of record and issues your invoices.
- Refunds: all payments, including renewals, are final and not refunded, and unused time is not credited, except where the law gives you a right to a refund.
6. Plan limits and fair use
Each plan has limits (for example emails per month, active leads and mailboxes). When you reach a limit the new action is blocked; existing data is not deleted.
7. Your content and data
You keep all rights to the leads, templates, emails and other content you upload or create ("Customer Data"). You grant us the rights needed to host, process and transmit Customer Data to provide the Service. Our processing of personal data on your behalf is governed by the Data processing addendum.
8. Our software and intellectual property
The Service, including its software, source code, design, text, graphics, logos, documentation and the names "Swift Outbox" and "Swift Pilot", is owned by Rasel Hakkani, trading as Swift Web Dev and protected by copyright and other intellectual property laws. All rights not expressly granted to you are reserved. Your plan gives you a limited, non-exclusive, non-transferable right to use the Service for your own business while your account is in good standing.
You may not, and may not help anyone else to: copy, modify or create derivative works of the Service; reverse engineer, decompile or try to extract its source code, except where the law allows this despite this restriction; resell, sublicense or rent access to the Service; scrape or bulk-download it or its documentation; use it to build a competing product; or remove any copyright or proprietary notice. If you send us feedback or suggestions, we may use them freely without any obligation to you.
9. Suspension and termination
We may suspend sending or the account, with notice where reasonable, if we believe you are breaching these terms or the Acceptable use policy, if your sending creates a risk to the Service or other customers, or if required by law. You may close your account at any time. On termination you may request an export during the retention period, after which Customer Data is deleted.
10. Warranties and liability
The Service is provided "as is". We do not guarantee deliverability, inbox placement, open or reply rates, or the accuracy of AI-generated text; you are responsible for reviewing what you send. To the extent permitted by law, our total liability for any claim is limited to the fees you paid in the 12 months before the claim, and neither party is liable for indirect or consequential losses.
11. Indemnity
You will indemnify us against third-party claims arising from email you send through the Service or from your breach of these terms or applicable law.
12. Changes to these terms
We may update these terms. For material changes we will give at least 30 days' notice by email or in the app. Continued use after the effective date means you accept the update.
13. Governing law
These terms are governed by the laws of Bangladesh, and the courts there have exclusive jurisdiction, except where mandatory law says otherwise.
